Privacy Policy

Short version: we collect your name and work email if you ask for the free guide, plus whatever you send us if you call, email, or apply for financing. We use it to get you funded. We do not sell it.

The long version is below. It is written to be read by a contractor, not a lawyer.

1. Who this policy covers

This policy explains how TrueSpark Financial handles information collected through this website, through phone calls to our funding desk, through email, and through the financing application we host at truesparkfinancial.com.

TrueSpark Financial is a commercial finance company. We arrange equipment financing, working capital and business lines of credit for construction, logging and excavation businesses. We do not offer consumer credit. Our products are for business use only.

The business responsible for the information described here is [LEGAL ENTITY NAME TO BE CONFIRMED], doing business as TrueSpark Financial.

A note for business contacts. This is a business to business company, and people sometimes assume that means privacy law does not apply. It does. Since January 1, 2023, California privacy law covers business to business contact information the same way it covers everything else. If you are a California resident, you get the full set of rights in section 10 even though you contacted us as a company owner and not as a consumer.

2. Information we collect

We only collect what you hand us, plus the basic technical data any website receives.

The free guide form on the home page

The form asks for two things: your first name and your work email address. That is it. There is no hidden field.

The financing application

If you start an application, you are taken to our application at truesparkfinancial.com. What you submit there comes to us. A commercial credit application typically asks for the legal business name, business address, tax ID, time in business, revenue, the equipment or funding you want, and owner or guarantor details.

If the application asks for an owner or guarantor Social Security number, date of birth, government ID number, or bank account and routing numbers, that is sensitive personal information. We collect it only to verify identity, evaluate the request, and set up funding. We do not use it to figure out anything about you as a person, and we do not sell it.

Calls and emails

If you call 972 419 4373 or email [email protected], we keep what you tell us: your name, your contact details, your business, and the notes from the conversation so the next person on your file is not starting over.

Technical data

Like every website, this one receives your IP address, browser type, device type, referring page, and the pages you visit. This is used for security and to understand traffic. It is not tied to your name unless you also submit a form.

CCPA and CPRA categories

California law makes us list this by category. In the last 12 months we have collected, or may collect, the following categories of personal information:

Identifiers. Name, business email, phone number, business address, IP address. Collected from you and from your device.
Customer records information. Name, signature, business address, telephone number, and financial account information submitted on an application.
Commercial information. The products you asked about, the amount and term you requested, and the history of what we discussed or arranged.
Internet or network activity. Pages viewed, time on page, referring site, and interactions with our calculators and forms.
Geolocation data. Approximate location derived from your IP address, at the city or region level. We do not collect precise device location.
Professional or employment information. Your job title, ownership role, and the business you represent.
Sensitive personal information. Only where an application requires it, such as a government ID number or a financial account number, and only for the permitted purposes described above.
Inferences. Basic conclusions drawn from the above, such as which funding program is likely to fit your business.

We do not collect biometric information, audio or visual recordings beyond ordinary business call notes, education records, or genetic data.

3. Where the information comes from

Directly from you, on a form, on a call, or in an email.
Automatically from your browser or device when you visit the site.
From lenders, funding partners and credit reporting agencies during the review of an application you submitted.
From public and commercially available business records, such as secretary of state filings and business credit files, when we verify an applicant business.

4. How we use it

To send the free guide you asked for.
To answer your question and call or email you back.
To evaluate your funding request and arrange financing.
To verify your business and the people who own it, and to prevent fraud.
To send you follow up about your file, your renewal, or a new program that fits your business. You can opt out of marketing email at any time using the unsubscribe link.
To operate, secure and improve this website.
To meet legal, regulatory, tax and recordkeeping obligations.

We do not use your information for any purpose that is unrelated or incompatible with the reason you gave it to us, and we do not use it to train general purpose artificial intelligence models.

5. Financing applications, lenders and credit bureaus

This is the part most privacy policies bury, so read it here.

When you apply for financing, we act as a commercial finance company arranging capital for your business. To do that, we share your application and supporting documents with lenders, funding partners, banks, lessors, and their underwriters. That is the whole point of applying: we shop the file so you do not have to.

We may also:

Obtain business credit reports and, with your authorization, personal credit reports on owners or guarantors.
Report information about your account to business credit reporting agencies.
Verify bank activity, tax identification numbers, equipment values, insurance, and lien positions.

Your initial review is a soft credit inquiry, which does not affect a score. A hard inquiry only happens with your specific authorization, when you decide to move forward on a particular offer.

Each lender or funding partner you are matched with handles your information under its own privacy policy once it receives your file. We are not able to control what they do with it after that, so ask them for their policy before you sign.

We share personal information in four situations, and no others.

Lenders and funding partners, as described in section 5, to get your deal done.
Service providers who run parts of our operation under contract and may only use the information to do the job we hired them for.
Professional advisors such as our attorneys and accountants, when needed.
Legal and safety, when we are required to respond to a subpoena, court order, regulator, or law enforcement request, or to protect our rights, prevent fraud, or protect someone's safety. Also to a buyer if the business is sold or merged, in which case this policy travels with the information.

The service providers involved in this website are:

Cloudflare hosts this site and provides security and bot protection at the network edge. Cloudflare processes your IP address and request data to serve pages and block attacks. See the Cloudflare privacy policy.
Google Fonts delivers the typefaces used on this site. Because your browser requests the font files directly from Google servers, Google receives your IP address and basic request headers when a page loads. Google states it does not use those requests to build advertising profiles. See the Google privacy policy. If you would rather not send that request, a browser extension that blocks third party font loading will stop it, and the site still works with fallback fonts.

We also use a customer relationship system, an email delivery service, a phone system, and a secure document portal to run the funding desk. Each is contractually limited to using your information only to provide that service to us. [SPECIFIC VENDOR NAMES TO BE ADDED ONCE THE STACK IS CONFIRMED]

7. Cookies, analytics and tracking

This site is a plain static website. It does not require cookies to work, and it does not set advertising cookies of its own.

Cloudflare may set a strictly necessary cookie to keep the site secure and to tell real visitors apart from bots. That one cannot be turned off without breaking security.

We may also use one or more of the following measurement and advertising services on this site. Where a service is not active, none of its cookies or scripts load and none of your data reaches it:

Google Analytics 4, to count visits and see which pages get read. It uses cookies or similar identifiers and receives a truncated IP address. Google privacy policy.
Microsoft Clarity, to produce heatmaps and anonymized session recordings that show where visitors get stuck. Clarity masks text typed into form fields. Microsoft privacy statement.
Meta Pixel, to measure advertising and build advertising audiences. If the Meta Pixel is enabled, that activity is treated as sharing for cross context behavioral advertising under California law, and the opt out in section 10 applies to it. Meta privacy policy.

You can block or delete cookies in your browser settings. You can also turn on Global Privacy Control in a supported browser or extension. We treat a Global Privacy Control signal as a valid request to opt out of sale and sharing for that browser.

Do Not Track. Browsers send a Do Not Track signal that has no agreed standard behind it, so we do not respond to it. We do respond to Global Privacy Control.

8. We do not sell or share your information

We do not sell personal information, and we have not sold personal information in the last 12 months. We do not sell or share the personal information of anyone under 16.

We do not share personal information for cross context behavioral advertising, except in one case: if the Meta Pixel described in section 7 is enabled on this site, the pixel data collected in your browser counts as sharing under California law. If that happens, you can opt out using the contact methods in section 10, or by turning on Global Privacy Control, or by blocking third party cookies. Nothing you submit on a form, and nothing from a financing application, is ever sent to an advertising platform.

9. How long we keep it

Free guide contacts. Until you unsubscribe, then a suppression record only, so we do not email you again.
Inquiries that never became an application. Up to 24 months, then deleted.
Applications that were declined or withdrawn. At least 25 months, because Regulation B requires records of business credit applications to be retained, and up to 5 years.
Funded transactions. For the life of the contract plus 7 years, to meet tax, accounting and regulatory recordkeeping rules.
Website and security logs. Generally 30 to 90 days.

When a retention period ends we delete the information or strip out anything that identifies you.

10. Your California privacy rights

If you are a California resident, you have the rights below. As noted in section 1, these apply to business contacts too.

Right to know. Ask what personal information we have collected about you, where it came from, why we collected it, who we disclosed it to, and get a copy.
Right to delete. Ask us to delete personal information we collected from you. We may keep what the law requires us to keep, such as records of a credit application or a funded transaction.
Right to correct. Ask us to fix personal information about you that is wrong.
Right to opt out of sale or sharing. Tell us not to sell or share your information for cross context behavioral advertising. See section 8.
Right to limit use of sensitive personal information. We only use sensitive personal information for the permitted purposes listed in section 2, which means this right is not triggered. If you send us a request anyway, we will honor it.
Right to non-discrimination. We will not deny you service, charge you a different price, or give you a worse deal because you used any of these rights.

How to make a request

Email [email protected] with the subject line "California Privacy Request" and tell us which right you are using. You can also call the funding desk at 972 419 4373.

We will confirm your request within 10 business days and answer it within 45 days. If we need more time, we will tell you why and take up to 45 more days.

Verifying you. Before we hand over or delete anything, we have to be reasonably sure it is you. We will ask you to confirm details we already have on file, such as the email you used or the business name on your application. We will not ask you for new sensitive information just to verify a request.

Someone acting for you. An authorized agent may submit a request on your behalf with written permission signed by you. We may still contact you directly to confirm.

Other states. If you live in a state with a comparable privacy law, such as Colorado, Connecticut, Virginia, Texas, Oregon or Utah, contact us the same way and we will apply the equivalent rights available to you.

11. Financial privacy under GLBA

Most of what we handle is business information, which sits outside the Gramm-Leach-Bliley Act. But a commercial credit file often contains nonpublic personal information about an individual owner or guarantor, such as a Social Security number, a personal credit report, or a personal financial statement.

Where GLBA applies to that information, we handle it under GLBA and its safeguards requirements. We collect it only to evaluate and arrange the financing you asked for, we share it only with the lenders, funding partners, credit reporting agencies and service providers needed to do that, and we protect it with administrative, technical and physical safeguards.

Information covered by GLBA is exempt from the California rights in section 10. That exemption covers the information itself, not you as a person, so any of your data that is outside GLBA still carries full California rights.

12. Security, children, changes and contact

Security

This site runs over HTTPS on every page. Documents you send for an application go through an encrypted portal, not loose email attachments. Access to files inside our business is limited to the people who need them to do the work. No system is perfectly secure, and we will not pretend otherwise, but we do not cut corners here.

Children's privacy

This is a business product. The site and our services are for business owners and authorized representatives who are 18 or older. We do not knowingly collect personal information from anyone under 18, and we have no reason to collect it from anyone under 13. If you think a minor sent us information, contact us and we will delete it.

Changes to this policy

We will update this policy when our practices change, when a new service goes live on the site, or when the law changes. The effective date at the top always shows the current version. If the change is significant, we will say so on the site.
